汕头市首单证券支持诉讼获法院立案受理
近日，广东金刚玻璃科技股份有限公司（以下简称“金刚玻璃”或“公司”）支持诉讼案获汕头市中级人民法院正式受理，投服中心委派北京市炜衡（广州）律师事务所公益律师张鹏代理1位投资者起诉。该案系投服中心在汕头市的首单证券支持诉讼。
连续多年虚增遗漏
公司终遭行政处罚
金刚玻璃于2020年4月20日公告收到中国证监会广东监管局《行政处罚决定书》（〔2020〕3号）及《市场禁入决定书》（〔2020〕1号）。金刚玻璃在2015年至2017年期间虚增营业收入、利息收入及营业利润，在2015年至2016年期间虚增货币资金，在2016年至2018年期间未按规定披露关联方非经营性占用资金的关联交易情况，导致连续多年的定期报告存在虚假记载、重大遗漏。
《行政处罚决定书》对金刚玻璃处以60万元罚款，并对24名责任人员作出3万至30万元不等处罚；《市场禁入决定书》对直接责任人员庄大建（时任董事长、总经理）、林仰先（时任财务总监）分别采取10年、5年证券市场禁入措施。
帮助投资者精准维权
支持诉讼广泛推进
投服中心持续关注投资者受损严重、社会影响较大的证券侵权纠纷典型案件，委派公益律师代理中小投资者依法维权。该案中，诉请揭露日至基准日期间股价虽总体呈上涨趋势，但诉请揭露日后5个交易日（含当日）内，股价累计下跌22.65%，投资者阶段性受损极其严重。支持起诉认为，本案实施日为2015年8月21日，即最早实施虚假陈述行为的《2015年半年度报告》公告日；揭露日为2019年1月25日立案调查日，且立案调查后股价下跌明显，符合司法解释关于揭露日的认定标准。同时，为实现对相关违法个人的精准追偿，投服中心坚持“追首恶”原则，支持投资者向庄大建、林仰先、金刚玻璃提起证券虚假陈述民事赔偿诉讼。
截至目前，投服中心已提起支持诉讼40件，诉求金额约1.21亿元，提起股东诉讼1件。未来，投服中心将积极推广“支持诉讼+示范判决”证券诉讼模式，推动支持诉讼案件作为示范案件先审先判，同时继续为特别代表人诉讼夯实基础，充分发挥投保机构示范引领作用，更好地维护投资者权益。
