警惕白银等贵金属“现货交易”陷阱
2014年某日，投资者黎某接到一个电话，对方声称是国内某知名贵金属交易所会员（以下称“公司”或“该公司”），开展白银等贵金属现货交易，交易方式灵活，交易时间长，可以T+0，即买即卖，不限次数，做多做空都可以赚大钱；投资者不懂也没关系，公司有专家进行指导，还可以代投资者操作，盈利全归投资者，公司只收取规定的手续费，投资者若有疑问，还可以去公司现场考察。
黎某一听，半信半疑，为稳妥起见，黎某决定去该公司经营现场“踩踩点”。按照公司业务员提供的地址，黎某来到位于成都高新区某高档写字楼内，公司热情地接待了他，公司现场很是“像模像样”，秩序井然，前来咨询的投资者也还真不少，有的正在询问洽谈，有的已经准备开户交易。黎某觉得这家公司“挺正规”，经简单了解后，当即办理了开户，投入资金七万元。由于自己不懂，便委托公司“专家”操作，没过几天，当投资者查看自己账户时，在“专家”大量频繁操作下，自己的资金早已亏损大半。
黎某感觉上当受骗后向当地政府金融办进行了举报，金融办调查收集相关证据后依法提请证监局对该公司的行为进行性质认定。根据金融办掌握的证据材料，该公司采用保证金制度，以集中交易的方式进行标准化合约交易，允许交易者以对冲平仓的方式了结交易。根据《期货交易管理条例》和国务院有关文件的规定，该公司组织的交易行为具备期货交易特征，涉嫌构成“非法组织期货交易活动”。目前，公安机关已对该公司进行立案调查。
提示：根据《期货交易管理条例》和国务院相关规定，除国务院和国务院金融监管部门批准的交易所之外，其他任何交易场所均不得采取集中竞价、电子撮合、连续交易等交易方式从事商品或权益交易，也不得采用集中方式进行标准化合约交易。投资者参与白银等贵金属交易一定要慎重，谨防掉入“现货交易”陷阱，造成财产损失；一旦发现自己受到此类非法活动侵害，应当及时向当地政府举报或向公安机关报案。
